PANEL RECRUITMENT SWEEPSTAKES RULES & REGULATIONS.

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW.

1. SWEEPSTAKES PERIOD: The Panel Recruitment Sweepstakes starts on March 1, 2023 at 00:00 EST and ends 72 hours after Entrants’ receipt of the Last Survey (the “Sweepstakes”). The Sweepstakes is sponsored by The Jewish People Policy Institute (“JPPI”), a non-profit organization. JPPI will publish whether the Sweepstakes is currently open on its Sweepstakes Website (https://jpanel.net).
2. ELIGIBILITY: This Sweepstakes is open to all persons who have completed the Background Survey, have opted in to join the Recruitment Panel (“Panel”), and are legal residents of the fifty (50) United States, the District of Columbia, or Canada (“Entrants”). All Entrants must be 18 years of age or older at the time of entry into the Sweepstakes and must live in a household with at least one person who identifies as Jewish. Employees, agents and representatives of the Sponsor and each of their respective advertising and promotion agencies are not eligible to win, nor are the parents, siblings and children of any such employee, agent or representative or any person with whom such employee, agent or representative is domiciled.

Entrants agree that they have read these Sweepstakes Rules and Regulations and agree to abide by and to be bound by the terms and conditions of the Sweepstakes Rules and Regulations. False and/or deceptive entries or acts shall render Entrants ineligible. JPPI’s eligibility decisions are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. A potential winner may be requested to provide proof that all eligibility requirements are met.

3. PRIZES: There will be several Prize Draws throughout the Sweepstakes. For the initial draw, there is (1) prize of (1) round-trip business-class airline ticket to Israel (ARV: $5,000 USD) or $5,000 travel voucher to an Israel-based travel agency (“First Draw Prize”). The First Draw Prize will be awarded once. Multiple Prizes will be available in each Subsequent Draw in the form of gift cards or equivalent during the remaining Sweepstakes (ARV: $500 USD). In each Subsequent Draw, Entrants are eligible to receive a variety of prizes including but not limited to digital gift certificates or gift cards. Once an Entrant wins a Prize in a Draw, they will not be eligible for any other Prizes awarded during that same Draw. From time to time, JPPI will update the list of potential prizes on its Sweepstakes Website (https://jpanel.net).

JPPI reserves the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.

Prizes are non-transferable and no substitution will be made except as provided herein at JPPI’s sole discretion. Unless otherwise specified in these Sweepstakes Rules and Regulations, Prizes are not redeemable for cash. Odds of winning a prize depend on the number of eligible entries received during the Sweepstakes.

Prizes are awarded “as is” with no warranty or guarantee, either express or implied by JPPI, including but not limited to, the quality, merchantability, habitability, mechanical condition, or fitness of the prize items. All expenses not specifically provided for herein are the responsibility of the prize winner. All properly claimed prizes will be awarded, but in no event will JPPI award more prizes than are provided for in these Sweepstakes Rules and Regulations or on JPPI’s Sweepstakes Website (https://jpanel.net). Prize codes will be sent to winners by mobile phone. JPPI is not responsible for the loss, delay or damage in delivery of any Prize.

4. HOW TO PARTICIPATE: The Sweepstakes is offered electronically via the All Entrants who become members of the Panel during the Sweepstakes are automatically entered into the Sweepstakes. To be admitted into the Panel, the Entrant must provide their mobile phone number and e-mail address to JPPI, complete the Background Survey, and meet all of the eligibility requirements to join the Panel. JPPI will verify Entrants’ mobile phone numbers and e-mail addresses by sending them a code using a third-party application. The Entrant must then confirm his/her membership on the Panel by following the instructions in the confirmation text messages and/or e-mail messages he/she receives upon completion of the Background Survey. Once the Entrant is admitted, he/she will be automatically entered into the Sweepstakes.

Once an Entrant has completed a Background Survey, opted into the Panel, and JPPI has confirmed the Entrant’s eligibility to participate, Panelists will be asked to complete Surveys at random intervals within 48 to 72 hours of receipt concerning their opinions regarding topics important to the Jewish diaspora.

Entrants may also participate by referring third-parties to the Panel. After successfully registering to participate in the panel, Entrants have an opportunity to increase their chances of winning the Sweepstakes by recruiting additional qualified panelists. Each Entrant eligible to participate in the Panel will receive a unique referral link to share with their friends, family, and social networks to recruit additional panelists. For each new qualified panelist an Entrant recruits, the Entrant will receive an additional ticket in the Sweepstakes. The Sweepstakes Website automatically keeps track of the referral link used by new registrants and Entrants are able to keep track of the number of people they successfully registered through their Profile page on the Sweepstakes Website (https://jpanel.net).

Entrants will receive one (1) entry into the Sweepstakes for the following actions:

• Registering for the Panel and completing the Background Survey;
• If accepted as a Panelist, answering Surveys, with (1) entry per Survey answered earned; and
• Referring eligible third-parties (such as friends or family) to also enter the Sweepstakes and register as a Panelist.

If multiple Survey completion attempts are received from the same mobile number or e-mail address only the first entry received will be qualified for the Sweepstakes; all additional entries will be disregarded. Entry will be deemed to have been submitted by the authorized account holder for the mobile number from which the entry is made. No entries by facsimile, overnight courier, delivery service or other type of electronic transmission will be accepted. Incomplete surveys will not receive entries, and JPPI is not responsible for entries/surveys that are lost, late, deleted, garbled, corrupted, misdelivered, or misdirected. JPPI is not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind. The use of automated or third-party software/applications or websites to enter is prohibited.

All entries completed and surveyed data becomes the property of the JPPI and will not be returned. All entries must be received by the close of the Sweepstakes.

5. NO PURCHASE NECESSARY TO ENTER OR WIN – ALTERNATE MEANS OF SWEEPSTAKES ENTRY: Completion of aSurvey is not required to enter the Sweepstakes. After first being accepted as a Panelist, Entrants may enter the Sweepstakes by using the alternate means of Sweepstakes entry set out below. Entrants may receive one (1) entry by legibly printing the Entrant’s name, street address, city, province, postal code, telephone number, complete email address, and the URL address for the Survey that Entrant received on a 3 x 5 inches (or 7.5 x 12.5 cm) piece of paper and mailing it to Panel Recruitment Sweepstakes, JPPI, Givat Ram Campus, P.O.B. 39156, Jerusalem, 9139101, Israel. All entries become the exclusive property of JPPI and will not be acknowledged or returned. Mail-in entries that do not include the URL address will not be valid. MAIL-IN ENTRIES MUST BE RECEIVED BEFORE THE LAST DAY OF THE APPLICABLE SWEEPSTAKES.
6. PRIZE AWARDING: Winners will be notified via text message or e-mail to the mobile number or e-mail address they provided in their Background Survey within fifteen (15) days of the drawing. Prizes will be awarded only on verification by JPPI that all Sweepstakes requirements have been met by the winners. Each Prize must be accepted as awarded and no substitution, transfer, conversion or assignment of Prize will be allowed, unless at the discretion of the Sponsor which may substitute a Prize of comparable or greater value. The winner will have three (3) calendar days from notification to accept the Prize by text message or e-mail, and will be instructed whom to contact at that time.

JPPI is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to notify the winner. If a selected Entrant cannot be contacted within the allotted time, JPPI reserves the right to void that entry and select another eligible Entrant for that Prize.

Each potential winner will be required to sign and return a Declaration of Compliance, Liability Waiver and where not prohibited a Publicity Release (“Declaration”) and an IRS Form W-9 which must be received by JPPI, within seven (7) days of the date notice or attempted notice is sent, in order to claim the Prize. If a potential winner of any Prize cannot be contacted, fails to sign and return the Declaration or provide any other requested information within the required time period, or the Prize is returned as undeliverable, the potential winner forfeits the Prize.

7. SWEEPSTAKES GENERAL RULES: By entering the Sweepstakes, Entrants agree to abide by these Sweepstakes Rules and Regulations and the decisions of JPPI, which are final.
8. WINNERS LIST: To obtain a copy of the winner list or a copy of the Sweepstakes Rules and Regulations, send your request to: prizes@jpanel.net.

9. DISQUALIFICATION: JPPI reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Sweepstakes if fraud, technical failures or any other factor beyond JPPI’s reasonable control impairs the integrity of the Sweepstakes (or portion thereof), as determined by JPPI in its sole discretion, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by JPPI in its sole discretion. JPPI is not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, or other error of any kind whether human, mechanical or electronic. Persons found tampering with or abusing any aspect of this Sweepstakes or the operation of the Sweepstakes Website or any other JPPI-hosted website, as determined by JPPI, in its sole discretion, will be disqualified. If disqualified for any of the above abuses, JPPI reserves the right to terminate the Entrant’s eligibility to

10. TAX INFORMATION: Liability for any applicable taxes imposed by any government, if any, on any Prize won, is the sole responsibility of the winner of such Prize. An IRS Form 1099 may be issued in the name of each verified Prize Winner, for the value of the prize received.

11. APPLICABLE LAWS: This Sweepstakes is subject to all applicable federal, state and county Void where prohibited or restricted by law.
12. PRIZE DISCLAIMER: JPPI shall not be responsible or liable to Entrants for any losses, damages or costs incurred as a result of Entrants entering the Sweepstakes or use of a Prize won in connection with this Sweepstakes or the failure by the JPPI to deliver the Prize to the winner in accordance with the Sweepstakes Rules and Regulations. By participating in the Sweepstakes, each Entrant agrees to release and hold harmless JPPI and its employees, officers, directors, agents, representatives, affiliates, advertising, promotion, and fulfillment agencies, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

13. RELEASE: By receipt of any prize, winners agree to release and hold harmless JPPI and its respective, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Sweepstakes or receipt or use or misuse of any prize.

14. INTELLECTUAL PROPERTY: Entrants, upon entering the Sweepstakes, hereby irrevocably grant to JPPI, and each of its licensees, successors and assigns, during the Sweepstakes, an exclusive, and thereafter non-exclusive, perpetual, royalty-free, no-cost license and right to use and otherwise exploit the data submitted as part of the Sweepstakes, and all elements, images, text and materials depicted therein, in whole or in part, in any manner or medium now or hereafter known or devised throughout the universe and in any and all languages, including, without limitation, the right to display, reproduce, record, perform, exhibit, distribute, copy, edit, change, modify, add to, subtract from, re-title and adapt the same, to combine it with other material and otherwise use and exploit it without having to give any compensation or attribution to entrants except for the awarding of the prizes in the Sweepstakes.

JPPI, and each of its successors, assigns and licensees, will have the right to make unlimited derivative works therefrom, to assign or transfer any or all such rights and to grant unlimited, multiple-level sublicenses. Without limiting the forgoing, JPPI will have the right to use the submissions submitted as part of the Sweepstakes, and all images depicted therein (if any), in any merchandising, advertising, marketing, promotion or for any other commercial or non-commercial purpose. Entrants hereby forever waive and relinquish all so-called “moral rights (droit moral)” now or hereafter recognized in connection with submissions submitted as part of the Sweepstakes. Entrants must maintain the ability to assign all rights to their entries to JPPI free of any limitations, restrictions or third-party obligations. Entrants agree that JPPI shall have the sole discretion in determining the extent and manner of use of submissions and are not obligated to use any submission. Entrants agree not to issue any publicity concerning JPPI. Entrants agree that neither JPPI, nor its agents, shall be responsible for return or preservation of the submissions submitted.

15. Representations, Warranties, and Indemnity: Each Entrant represents and warrants that he or she has the right to agree to and fully perform consistent with these Sweepstakes Rules and Regulations and the consent of no third parties are required to grant the rights hereunder. Entrants agree (as permitted by applicable law) to indemnify and hold the Released Parties harmless from and against any third-party claims, to the extent relating to any breach of any representation, warranty or covenant made by such entrant in connection with his or her acceptance of these Sweepstakes Rules and Regulations or Sweepstakes activities.
16. Disputes: Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by courts in Israel; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Sweepstakes Rules and Regulations, or the rights and obligations of the entrant and JPPI in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of New York without giving effect to any choice of law or conflict of law rules (whether of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New York.

Neither the failure of JPPI to insist upon or enforce strict performance of any provision of these Sweepstakes Rules and Regulations or the failure, delay or omission by JPPI in exercising any right with respect to any term of these Sweepstakes Rules and Regulations, will be construed as a waiver or relinquishment to any extent of JPPI’s right to assert or rely upon any such provision or right in that or any other instance.

 DATA PRIVACY: By participating in the Sweepstakes, Entrants consent to JPPI’s collection, use, and disclosure of their personal data in accordance with JPPI’s Privacy and Data Protection Policy and Notice, which may be found at https://jpanel.net/privacy/. Entrants hereby acknowledge that they have read and accept the terms of JPPI’s Privacy and Data Protection Policy and Notice. JPPI may use Entrants’ personal data for (1) the proper administration and fulfillment of the Sweepstakes as described in these Sweepstakes Rules and Regulations, including to communicate with Entrants in relation to the Sweepstakes; (2) internal research purposes; and (3) other activities described in JPPI’s Privacy and Data Protection Policy and Notice. JPPI will not sell any Entrants’ personal data collected in connection with the Sweepstakes or make such personal data available to third parties for marketing purposes.
